Entity: Health Mastery Limited (綽峰醫學有限公司)
1. About These Terms
These Terms of Use ("Terms") govern your access to and use of the Health Mastery website, applications, learning management functions, event registration services, professional learning portals, public health information portals, communications and related products and services (collectively, the "Platform" or "Services").
By creating an account, enrolling in a course or event, making a purchase, clicking to accept these Terms or otherwise accessing or using the Services, you agree to be bound by these Terms, together with our Privacy Statement and Personal Information Collection Statement, Refund and Cancellation Policy, Acceptable Use Rules and any course-, event-, employer- or programme-specific terms made available to you (collectively, the "Platform Terms").
If you use the Services on behalf of a hospital, clinic, employer, professional association, course provider or other organisation, you represent and warrant that you have authority to accept the Platform Terms on behalf of that organisation.
If you do not agree to these Platform Terms, you must not access or use the Health Mastery Platform or Services.
2. Important Role of Health Mastery
Health Mastery provides an online platform for professional learning, course administration, event management, continuing education support and related information services.
Unless expressly stated in a written agreement and the relevant course notice, Health Mastery is not:
- a statutory licensing, registration, disciplinary or regulatory authority;
- a professional register, professional college or universal accreditation body;
- the issuer of a practising certificate, licence, professional qualification or statutory credential; or
- a provider of medical diagnosis, treatment, telemedicine, patient management or clinical consultation.
A course's accreditation, certificate, professional credit or reporting status is determined solely by the relevant course information and the applicable rules of the accrediting body, programme administrator, professional organisation or regulator.
General information displayed on the Platform should not be interpreted as guaranteeing accreditation or suitability for every profession, specialty, licensing cycle or registration category.
3. Eligibility, Accounts and Professional Information
You must be legally capable of entering into a binding agreement before using the Services. Where a course or Service is intended only for qualified healthcare professionals or adults, you must satisfy the applicable eligibility requirements.
You agree to provide information that is accurate, complete, current and not misleading, including your name, contact details, professional role, licence or registration number, employer, specialty and other information required for course enrolment, certification or reporting purposes.
You are responsible for protecting your login credentials and all activity occurring under your account. You must promptly notify Health Mastery if you suspect unauthorised access or misuse of your account.
- Do not share your username or password.
- Do not share course access or certificates.
- Do not share assessments or examination attempts.
- Managed organisational accounts may only be used where expressly authorised.
Health Mastery may request reasonable evidence to verify your identity, professional status or eligibility before granting access to certain credit-bearing courses, certificates or reporting functions.
4. Professional Learning, Accreditation, Certificates and Credit Records
4.1 Course-specific Status
Before enrolling in a certificate or credit-bearing course, you should carefully review the relevant Course Listing Statement, including eligibility requirements, professional group, accreditation status, completion criteria, assessment conditions, attendance requirements, reporting method and any additional terms.
Health Mastery may update, correct, suspend or withdraw course information where accreditation changes, approvals expire, course content changes or information is found to be inaccurate.
4.2 No Guarantee of Credit, Registration or Licensing Outcome
Health Mastery facilitates learning records, attendance verification, assessments and certificates but does not guarantee that completion of a course will result in professional credit, licence renewal, employment, reimbursement or recognition by any third party.
- CME, CPD, CNE, CPE or other professional credits;
- Acceptance by employers, insurers or professional bodies;
- Licence or practising certificate renewal;
- Professional registration or specialist recognition;
- Employment, credentialing or reimbursement outcomes.
You remain responsible for maintaining your own professional registration, continuing education obligations and regulatory requirements.
4.3 Completion, Verification, Audit and Correction
For credit-bearing learning activities, Health Mastery or the relevant programme administrator may require attendance verification, identity verification, minimum viewing time, assessment completion, declarations and other published completion criteria.
You must complete all learning activities personally unless collaboration is expressly permitted. The use of another person, automation, bots, undisclosed AI tools or falsified attendance evidence is prohibited.
Health Mastery may investigate suspected fraud, impersonation, misuse or failure to satisfy published course requirements. Where appropriate, completion records, certificates or credit records may be withheld, corrected, cancelled, revoked or reissued.
4.4 Certificates
Unless expressly stated otherwise in the Course Listing Statement, a Health Mastery certificate records only that the learning activity has been completed through the Platform.
A Health Mastery certificate is not a professional qualification, licence, practising certificate, regulatory approval or endorsement. It does not represent that a learner is competent to perform any clinical procedure or provide any healthcare service.
5. Medical-Education and Clinical-Use Disclaimer
Platform content is provided solely for education, information, and professional development. It may include opinions, research, clinical guidelines, case studies, presentations, simulations, and materials prepared by third-party instructors, institutions, sponsors, authors, or other contributors.
The Services do not provide medical advice, diagnosis, treatment recommendations, prescribing advice, clinical supervision, patient-specific recommendations or emergency assistance.
Healthcare knowledge continually evolves. Course content may not always be complete, current, applicable in every jurisdiction or suitable for every patient, clinical setting or professional practice.
You remain solely responsible for exercising your own professional judgment, practising within your authorised scope of practice, consulting current evidence and authoritative references, obtaining specialist advice where appropriate, and complying with applicable legislation, institutional policies, ethical standards and patient safety requirements.
You must not rely solely on Platform content when making any clinical, diagnostic, treatment, prescribing or patient-management decision.
If you are a member of the public, you should not delay seeking professional medical advice or emergency assistance because of information obtained through the Platform.
In a medical emergency, immediately contact your local emergency services or an appropriately qualified healthcare professional.
6. Patient Data, Confidential Information and Sensitive Material
The Platform is not designed to receive, process or store patient records, patient-identifiable information or confidential clinical information unless Health Mastery has expressly established a secure and authorised workflow with separate written instructions.
- Patient-identifiable information
- Medical records
- Patient photographs or videos
- Clinical audio recordings
- Laboratory reports
- Care plans
- Prescriptions
- Insurance information
- Any confidential health information
Such information may only be submitted where you have obtained all required legal authority, approvals, permissions and consents, and where Health Mastery has expressly authorised the submission in writing.
When submitting case studies, discussion materials or educational examples, you must ensure all information is appropriately de-identified and complies with applicable privacy legislation, confidentiality obligations, intellectual property rights, employment requirements and professional ethical standards.
You remain solely responsible for all content you upload or submit through the Platform.
7. Acceptable Use and Professional Conduct
You must use the Services lawfully, responsibly and in a manner consistent with professional integrity.
You must not, nor attempt to:
- Impersonate another person or misrepresent professional credentials.
- Falsify attendance, assessments, certificates or completion records.
- Use the Services in breach of any law, professional code or institutional policy.
- Upload unlawful, defamatory, discriminatory, threatening or inappropriate content.
- Use certificates or learning records in a misleading manner.
- Use bots, crawlers, scripts, reverse engineering or other unauthorised automated tools.
- Copy, reproduce, record, distribute, resell or commercially exploit Platform content without written permission.
- Interfere with security systems, payment systems, assessments or Platform operations.
- Use the Platform to provide unauthorised clinical advice or patient services.
Health Mastery may remove content, suspend accounts, restrict access or take any reasonable action where user conduct violates these Terms, threatens patient safety, compromises assessment integrity, infringes legal rights or adversely affects the Platform.
8. Platform Content, Intellectual Property and User Content
All Platform content, including software, branding, interfaces, graphics, videos, audio, text, course materials, databases and related content are owned by or licensed to Health Mastery, its affiliates, instructors, licensors or other rights holders, and are protected by applicable intellectual property laws.
Subject to your compliance with these Terms and payment of any applicable fees, Health Mastery grants you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to access authorised Platform content solely for your own personal, internal professional and non-commercial learning purposes.
You retain ownership of any content you lawfully submit through the Platform. However, by submitting content, you grant Health Mastery a worldwide, non-exclusive, royalty-free licence to host, reproduce, display, transmit, moderate, secure and otherwise operate the Services in connection with that content.
You represent and warrant that you possess all necessary rights, permissions and lawful authority required to submit such content and grant the above licence.
If you believe any material on the Platform infringes your intellectual property rights or privacy rights, please contact Health Mastery at cs@thehealthmastery.com with sufficient information for assessment.
9. Fees, Course Providers, Subscriptions, Refunds and Events
9.1 Provider of the Course and Applicable Policy
Courses, programmes, events, webinars and other learning activities available through the Platform may be provided either directly by Health Mastery or by a cooperating healthcare organisation, professional association, education provider, hospital, clinic, academic institution or another authorised course provider ("Provider").
The applicable Course Listing Statement will identify, where practicable, the course Provider, merchant of record, access period, pricing, currency, taxes, payment terms, refund policy and any other applicable conditions before enrolment or purchase.
Where a course is delivered by an external Provider, that Provider's refund, cancellation and course policies will normally apply. Health Mastery may facilitate requests only to the extent agreed with the Provider.
If any inconsistency exists between these Terms and a clearly identified Provider policy, the Provider policy shall govern that particular Provider Course to the extent permitted by law, unless Health Mastery is expressly identified as the merchant of record.
9.2 General Refund Policy for Eligible Health Mastery Courses
This refund policy applies only to eligible one-time paid courses provided directly by Health Mastery where no separate refund policy has been published.
A full refund may be requested only if both of the following conditions are satisfied:
- Refund request submitted to cs@thehealthmastery.com within 7 business days of payment.
- No certificate, attendance record, CPD certificate or other completion document has been issued.
For pre-enrolment courses, the Course Listing Statement may specify that the refund period begins on the published course launch date instead of the payment date.
Once a certificate or equivalent completion record has been issued, you will generally no longer be eligible for a refund. If a certificate has been issued in error, please contact Health Mastery promptly for review.
- Provider Courses with separate refund policies
- Subscriptions
- Live events with separate conditions
- Pre-paid packages
- App Store purchases
- Products with clearly disclosed alternative refund policies
Health Mastery may refuse or adjust a refund request where there is evidence of fraud, misuse, breach of these Terms or payment error, subject to applicable law.
Where a refund is approved, Health Mastery may cancel course access and update associated certificates, completion records or CPD records where necessary to preserve record accuracy.
Where payment gateway, credit card or other transaction fees are non-refundable, any applicable transaction fees may be deducted from the refunded amount and borne by the registrant.
9.3 Subscriptions, Trials and Renewals
Where Health Mastery offers recurring subscriptions, the subscription page or Course Listing Statement will clearly describe:
- Billing period
- Subscription fees
- Taxes
- Automatic renewal terms
- Trial period (if applicable)
- Cancellation method
- Refund eligibility
Cancelling a subscription prevents future renewal charges but does not automatically refund subscription fees already paid, unless required by law or expressly stated otherwise.
Access to paid content will normally continue until the end of the current billing period.
9.4 General Payment Conditions
By placing an order, you authorise Health Mastery and its payment providers to charge your nominated payment method for all fees payable for courses or services where Health Mastery is the merchant of record.
Fees are generally non-refundable except where expressly stated in the Course Listing Statement, Refund Policy, Provider policy or where required by applicable law.
Health Mastery may revise pricing for future purchases or subscription renewals after providing any notice required under applicable law.
10. Third-Party Services, Providers and Links
The Platform may include third-party content, courses, webinars, payment gateways, cloud services, technical integrations, advertisements, links and other external services.
A learning activity may be delivered either directly by Health Mastery or by an external Provider. Where applicable, the relevant Course Listing Statement will identify the Provider and any applicable course-specific terms.
Provider Courses may be governed by the Provider's own admission, attendance, certification, accreditation, cancellation, refund and privacy policies.
Health Mastery's role as Platform operator, administrator or payment facilitator does not automatically make Health Mastery the Provider of a course unless expressly stated.
Third-party services operate under their own terms and privacy policies. Health Mastery does not control or guarantee the availability, security, accuracy or practices of third-party services except where required by law.
Health Mastery may disclose limited personal information or learning records to authorised course providers, professional bodies, accreditors, programme administrators, payment providers, technical service providers or regulators only as described in our Privacy Statement, Course Listing Statement or where required by applicable law.
11. Privacy and Electronic Communications
Health Mastery's collection, use, retention, disclosure, security, access and correction of personal data are governed by our Privacy Statement and Personal Information Collection Statement, which forms part of these Terms of Use.
By using the Platform, you consent to receive service-related communications by email, in-app notification, SMS or other contact methods you have provided, where permitted by law.
- Account notifications
- Security alerts
- Payment confirmations
- Course and event updates
- Certificates and CPD records
- Policy updates
Marketing communications are managed separately in accordance with the Privacy Statement and your communication preferences.
Health Mastery may maintain electronic records relating to your acceptance of these Terms, account activity, enrolment, attendance, learning progress, assessments, certificates, communications and payment history where reasonably necessary to operate the Platform, resolve disputes, protect learning integrity and comply with legal obligations.
12. Suspension, Termination and Service Changes
Health Mastery may suspend, restrict or terminate access to all or part of the Platform where reasonably necessary due to:
- Material breach of these Terms
- Non-payment of fees
- Fraud or impersonation
- Academic dishonesty
- Security risks
- Unlawful conduct
- Professional misconduct
- Intellectual property infringement
- Legal or regulatory requirements
- Reasonable request from an authorised course provider, accreditor or competent authority
Where reasonably practicable, Health Mastery will provide notice and an opportunity for you to respond before taking action. Immediate suspension may occur where necessary to protect users, patient safety, Platform security, learning integrity or legal compliance.
Health Mastery may modify, suspend or discontinue features, courses, events or Services from time to time.
Where a material paid Service is discontinued before the promised access period ends, Health Mastery will use reasonable efforts to provide advance notice and any remedy required under applicable law.
Provisions relating to intellectual property, confidentiality, personal data, disclaimers, limitation of liability, indemnity, dispute resolution and outstanding payment obligations will continue after termination where appropriate.
13. Disclaimers

- Content will always be complete, current or suitable for every purpose.
- Every certificate, attendance record or assessment result will be accepted by a third party.

14. Limitation of Liability
To the fullest extent permitted by applicable law, Health Mastery and its affiliates, directors, employees, agents, licensors, instructors, course providers and suppliers shall not be liable for indirect, incidental, consequential, exemplary, punitive or special damages.

To the maximum extent permitted by law, Health Mastery's total aggregate liability, whether arising in contract, tort (including negligence), statute or otherwise, shall not exceed:
The greater of the total fees actually paid by you to Health Mastery for the affected paid Service during the twelve (12) months immediately preceding the event giving rise to the claim, or any minimum amount required by applicable law.
15. Indemnity
To the maximum extent permitted by applicable law, you will indemnify and keep indemnified Health Mastery and its affiliates, directors, officers, employees, agents, licensors, and suppliers against reasonable losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from or in connection with your material breach of the Platform Terms, unlawful use of the Services, infringement of a third party’s rights, unauthorised disclosure of patient or confidential information, or fraudulent use of a professional credential or learning record.
This clause does not require you to indemnify Health Mastery for loss caused by Health Mastery’s own negligence, wilful misconduct, breach of law, or other conduct for which indemnity would be unenforceable.
16. Changes to These Terms
Health Mastery may update these Terms to reflect changes to the Services, legal or regulatory requirements, security needs, course-provider arrangements, or business practices. The current version and effective date will be displayed on the Platform.
For material changes, Health Mastery will give reasonable notice by the Platform, email, or another appropriate method, unless a change must take effect sooner for legal, security, fraud-prevention, or urgent operational reasons. Your continued use after the effective date constitutes acceptance to the extent permitted by applicable law. If you do not agree to a material change, you must stop using the affected Services and may contact Health Mastery about available options for any unaffected prepaid access.
17. Governing Law, Disputes, and General Terms
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong will have non-exclusive jurisdiction over disputes arising out of or in connection with the Platform Terms, subject to any mandatory rights or protections that apply to you.
You may not assign or transfer your rights or obligations under these Terms without Health Mastery’s prior written consent. Health Mastery may assign these Terms in connection with a reorganisation, merger, acquisition, or transfer of all or substantially all relevant assets, subject to applicable law.
Where Health Mastery provides a Chinese translation of these Terms, the English version will prevail to the extent of any inconsistency, unless applicable law requires otherwise.
